Ship Class in Charter Party

Every charter party will state what the vessel’s classification status is and will normally oblige owners to maintain this class throughout the charter. In addition to the statement as to the vessel’s class at the date of the charter, the maintenance obligations set out in the charter will oblige owners to comply with class requirements as to surveys and inspections. However, if, after the date of the charter, the vessel loses her class in spite of owners maintaining a prudent programme of inspections and maintenance, there is no breach of the maintenance obligation or the vessel’s description. If the vessel were to lose her class, ship owners would have to take reasonable steps within a reasonable time to have her class restored SNIA v Suzuki (1924).
